To help academic associations in management develop, refine, and implement a code of ethics, we conducted a survey of management educators’ perception of the ethicality of 142 specific behaviors in teaching, research, and service. The results of the survey could be used to inform ethics committees of these associations regarding the level of acceptability of such conduct. The potential value of our study for the Academy of Management or similar management associations lie in our (1) systematically involving the members in (...) building support for the code of ethics, (2) assessing members’ ethical judgments on both cross-sectional and longitudinal bases so as to identify areas needing particular attention in ethical training, (3) providing an extensive list of specific examples of questionable and potentially unethical behaviors so as to make it easier to implement the code, and (4) providing a template survey document for potential use in involving more stakeholder groups in the development of codes of ethics. This paper builds on previous work by Sirgy, M. J., Journal of Business Ethics 19, 193–206, dealing with issues of code of conduct of marketing educators. Sirgy developed a discussion document outlining a semblance of what might be construed as a code of ethics for marketing educators. The discussion document was debated and accompanied by three commentaries. One conclusion derived from the discussion document and the commentaries is the need to develop a code of ethics involving behaviors that most marketing (...) educators find morally unacceptable. The current paper reports on a descriptive study involving a survey of marketing educators in which survey respondents were asked to rate the extent to which certain behaviors are deemed acceptable or unacceptable. The results of the survey identified certain behaviors deemed unacceptable by the vast majority of survey respondents. This evidence of hypernorms within the community of marketing educators was used to propose an initial code of ethics. (shrink)

If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

BackgroundIn the Canadian Alliance for Healthy Hearts and Minds (CAHHM) cohort, participants underwent magnetic resonance imaging (MRI) of the brain, heart, and abdomen, that generated incidental findings (IFs). The approach to managing these unexpected results remain a complex issue. Our objectives were to describe the CAHHM policy for the management of IFs, to understand the impact of disclosing IFs to healthy research participants, and to reflect on the ethical obligations of researchers in future MRI studies.MethodsBetween 2013 and 2019, 8252 participants (...) (mean age 58 ± 9 years, 54% women) were recruited with a follow-up questionnaire administered to 909 participants (40% response rate) at 1-year. The CAHHM policy followed a restricted approach, whereby routine feedback on IFs was not provided. Only IFs of severe structural abnormalities were reported.ResultsSevere structural abnormalities occurred in 8.3% (95% confidence interval 7.7–8.9%) of participants, with the highest proportions found in the brain (4.2%) and abdomen (3.1%). The majority of participants (97%) informed of an IF reported no change in quality of life, with 3% of participants reporting that the knowledge of an IF negatively impacted their quality of life. Furthermore, 50% reported increased stress in learning about an IF, and in 95%, the discovery of an IF did not adversely impact his/her life insurance policy. Most participants (90%) would enrol in the study again and perceived the MRI scan to be beneficial, regardless of whether they were informed of IFs. While the implications of a restricted approach to IF management was perceived to be mostly positive, a degree of diagnostic misconception was present amongst participants, indicating the importance of a more thorough consent process to support participant autonomy.ConclusionThe management of IFs from research MRI scans remain a challenging issue, as participants may experience stress and a reduced quality of life when IFs are disclosed. The restricted approach to IF management in CAHHM demonstrated a fair fulfillment of the overarching ethical principles of respect for autonomy, concern for wellbeing, and justice. It is initially odd to ask whether Confucianism is compatible with systems of law. Confucian thought has co-existed with Chinese legal systems throughout the various dynasties of China’s long history. Nevertheless, despite the extensive laws that China has boasted, traditional Chinese legal thought is not typically recognized as a genuine rule-of-law system, given its focus on moral development and the “rule of man.” In this essay, we argue that Confucianism, specifically Pre-Qin Confucianism, is compatible with the rule-of-law. We examine the (...) different models of compatibility, including “soft compatibilism” in which we examine whether abstract concepts between Confucianism and legal systems are compatible, as well as co-existing and integrating compatibilism. Co-existing compatibilism sees Confucianism and the law occupying different spheres within the same legal system while integrating compatibilism sees Confucianism and the law coming together into a new system. In this way, Confucianism offers China an alternative to liberal democratic and Marxist theories of law. (shrink)

This essay deals with two poetics of distinctly different traditions that arrived at the same concept of literary art, one in which the reader of, or listener to, a poem shares in the creative process with the poet. The first tradition I will examine is the that of the pre-Hispanic Mexican poets of the Cantares mexicanos and the 20th- century appropriation of their work by two of Mexico's most distinguished poets, Octavio Paz (1914–1998) and ]ose Emilio Pacheco (1939–2014), both awarded (...) the Premio Cervantes, and Paz, the Nobel Prize. The second part of this essay examines the contemporary Continental tradition of philosophical hermeneutics that began with Martin Heidegger (1889–1976) and Hans-Georg Gadamer (1900–2001) and culminated in the work of Paul Ricoeur (1913– 2005). Although Heidegger is now well known among philosophers throughout the world, it should be noted that ]ose Gaos of the National University of Mexico, an exile from Spain, completed the first translation of Heidegger's Sein und Zeit in 1951, more than a decade before the English and French translations appeared. The purported failures of ergodic theory (seen in its often proved ineptitude to ground a mechanical explanation of thermodynamics) are shown to arise from misconception of the functions served by scientific explanation. In fact, the predictive failures of ergodic theory are precisely its points of greatest physical utility, where genuinely new knowledge about actual physical systems can be obtained, once the links between explanation and reconstructive estimation are recognized.

In this paper, we argue that our moral concern for future well-being should reduce over time due to important practical considerations about how humans interact with spacetime. After surveying several of these considerations (around equality, special duties, existential contingency, and overlapping moral concern) we develop a set of core principles that can both explain their moral significance and highlight why this is inherently bound up with our relationship with spacetime. These relate to the equitable distribution of (1) moral concern in (...) a universe that we can only causally affect in one temporal direction; (2) access to the benefits from using spacetime as a resource; and (3) the burdens of care given (1) and (2). We conclude by considering the practical implications of our argument and find that, while it is often assumed that a preference for present over future well-being weakens the case for existential risk mitigation, this likely is not the case. Stakeholder theory is widely recognized as a management theory, yet very little research has considered its implications for individual managerial decision-making. In the two studies reported here, we used stakeholder theory to examine managerial decisions about balancing stakeholder interests. Results of Study 1 suggest that indivisible resources and unequal levels of stakeholder saliency constrain managers’ efforts to balance stakeholder interests. Resource divisibility also influenced whether managers used a within-decision or an across-decision approach to balance stakeholder interests. The mechanism of stellar aberration was explained and formulated by Bradley in terms of the existence of a unique reference frame for light propagation. However, Einstein's denial of the existence of such a frame appears to undermine Bradley's interpretation of the phenomenon. It is suggested that the recent evidence for a cosmologically-based inertial reference frame provides a new physical basis for Bradley's explanation in a manner consistent with the requirements of special relativity. It is shown that a “delay” effect is (...) also involved in our observation of the direction of nearby sources, and that the aberration and delay effects exactly compensate for nearby sources comoving with a terrestrial observer. The Lorentz transformation relates the Einstein-defined measures, associated with two inertial frames, of the space and time coordinates of a body or event. From such information relative velocities and accelerations may be deduced, and their appropriate transformations derived. All other transformations of special relativity are derived from the Lorentz transformation and hence depend on the coordinate measures related by the transformation. In particular, the transformation of forces depends on that for accelerations; hence it may not be appropriately applicable to equilibrium (...) phenomena involving null-acceleration. It is suggested that this is the root of the apparent paradox which arises when the conventional force transformation is applied to the consideration of a right-angled lever in equilibrium in its proper inertial frame. It is shown that this paradox is resolved by the employment of a nonconventional but appropriate special relativistic transformation for forces not associated with corresponding accelerations. In this paper the authors argue that research ethics committees should not be paternalistic by rejecting research that poses risk to people competent to decide for themselves. However it is important they help to ensure valid consent is sought from potential recruits and protect vulnerable people who cannot look after their own best interests. The authors first describe the tragic deaths of Jesse Gelsinger and Ellen Roche. They then discuss the following claims to support their case: competent individuals are epistemologically (...) and ethically in the best position to say which risks are reasonable for them, so RECs should be no more restrictive than the “normal” constraints on people taking risks with themselves; RECs do not judge individual competence ; individual liberty is mostly limited by what serves the public interest, and RECs do not determine public interest; RECs may have a paternalistic role in preventing exploitation of competent people vulnerable to the use of incentives, and in protecting the interests of incompetent people; however, the moral and political authority of RECs has not been established in this respect. In the academic year 1920-1921 at the University of Freiburg, Martin Heidegger gave a series of extraordinary lectures on the phenomenological significance of the religious thought of St. Paul and St. Augustine. The publication of these lectures in 1995 settled a long disputed question, the decisive role played by Christian theology in the development of Heidegger’s philosophy. The lectures present a special challenge to readers of Heidegger and theology alike. Experimenting with language and drawing upon a wide range of now (...) obscure authors, Heidegger is finding his way to Being and Time through the labyrinth of his Catholic past and his increasing fascination with Protestant theology. This article concerns the morality of establishing regulated kidney markets in an effort to reduce the chronic shortage of kidneys for transplant. The article tries to rebut the view, recently defended by James Taylor, that if we hold autonomy to be intrinsically valuable, then we should be in favor of such markets. The article then argues that, under current conditions, the buying and selling of organs in regulated markets would sometimes violate two Kantian principles that are seen as moral constraints. (...) One principle forbids expressing disrespect for the dignity of humanity; the other forbids treating others merely as means. In light of the moral danger posed by regulated markets, the article advocates an alternative way of diminishing the current organ shortage, namely opt-out systems of cadaveric organ donation. By empirically investigating the neural correlates of the basic experience one makes of oneself as bodily self and of its alterations, new light can be shed on the relationship between self-disturbances and social deficits in schizophrenia. We review recent neuroscientific evidence showing how a pre-reflective, experiential understanding of others can be accomplished, so that others are conceived as bodily selves by means of neural reuse of our own sensorimotor and visceromotor resources, and how a clear distinction between self and other (...) is normally preserved. By conjugating identity and alterity, a putative neural mechanism is provided underpinning the blurring of such distinction in schizophrenic patients. The reviewed empirical data suggest brain function anomalies at the levels of multisensory integration, differential processing of self- and other-related bodily information, and mediating self-experience at the basis of an imbalance in the pre-reflective relationship of the embodied self to the world including the social environment. The early Schelling and the romantics constructed the unconscious in order to overcome the modern split between subjectivity and nature, mind and body, a split legislated by Cartesian representationalism. Influenced by Boehme and Kabbalah, the later Schelling modified his notion of the unconscious to include the decision to be oneself, which must sink beneath consciousness so that it might serve as the ground of one's creative and personal acts. Slavoj Zizek has read the later Schelling's unconscious as a prototype of (...) Lacan's reactive unconscious, an unconscious that only exists as the excluded other of consciousness. This reading, though close to the text of Schelling, misses something essential: the unconscious for Schelling is not a repression but a condition of the possibility of life and love. (shrink)

Cora Diamond has recently criticised as mere legend the interpretation of a quip of Ramsey's, contained in the epigraph below, which takes him to be objecting to or rejecting Wittgenstein's Tractarian distinction between saying and showing. Whilst I agree with Diamond's discussion of the legend, I argue that her interpretation of the quip has little evidential support, and runs foul of a criticism sometimes made against intuitionism. Rather than seeing Ramsey as making a claim about the nature of propositions, as (...) Diamond does, we should understand him as making a claim about the grammar of the logical connectives. Such a view coheres with the extant evidence of the nature of Wittgenstein's and Ramsey's 1929 philosophical encounters. It is also compatible with attributing to Ramsey a recognition of Wittgenstein's distinction and with denying that criticising it is the lesson of the quip. (shrink)
